Can a power of attorney sign a reverse mortgage?

Why I raise signing authority early when a family is helping a parent with a HECM.

A power of attorney may be part of a reverse mortgage transaction, but having a recorded document is not the same as having lender-accepted authority for every step. I want the lender and the family’s attorney to review the actual documents early, before the family relies on a closing date.

The obstacle was not the loan amount

In a HECM file I worked through, there was a recorded durable power of attorney and a concern about demonstrating competency in connection with signing. Conservatorship became part of the discussion. The important point is not that every similar family needs a conservatorship. It is that a financially plausible loan still needs an acceptable way to complete the transaction.

The notes do not establish a final legal determination or a completed closing. They do explain why I treat signing authority as an early planning question. Waiting until documents are ready can leave a family trying to resolve a legal issue on a mortgage deadline.

Give each professional the right question

I can help identify what the lender needs to review. I cannot determine whether a parent has legal capacity, interpret a power of attorney as the family’s lawyer, or tell a family which court process it needs. The attorney addresses legal authority. The lender and title professionals address the documents they can accept for the transaction.

HUD’s HECM policies address powers of attorney and borrowers lacking legal competency. The applicable requirements must be checked against the facts and documentation, not inferred from a generic form. See HUD Handbook 4000.1 and its current updates (new tab).

  • Who owns the property, and who would be the borrower?
  • Who is expected to sign, and under what authority?
  • Has the complete document, including amendments, been reviewed?
  • Are there questions about capacity, effective dates or the scope of authority?
  • What does the counselor need in order to complete the required counseling process?

Separate the housing goal from the paperwork path

The family may be trying to improve cash flow, arrange care or keep the parent in the home. Those goals deserve a conversation even while legal questions are being resolved. I would build two lists: the financial decision to evaluate and the authority or documentation that must be established before anyone can proceed.

This also helps avoid paying for unnecessary steps too soon. Ask which reviews should happen before ordering services, what fees could be incurred and which dates remain tentative. If legal review changes the available path, the family should understand that before relying on loan proceeds for an urgent bill.

What I would ask you to bring

Start with a general explanation of the goal and who is helping the homeowner. We can arrange a secure way to provide the complete authority documents, relevant title information and the attorney’s contact details with appropriate permission. Do not put medical records or copies of legal documents into a public contact message.

Does recording a durable POA guarantee the lender will accept it? No. It gives the reviewers a document to evaluate; it does not settle every authority, counseling or execution question. Likewise, a problem with one document does not establish that a reverse mortgage is impossible.

The practical lesson from this file is to bring the authority question forward. Then the family, attorney, counselor and lender can work in a deliberate sequence rather than trying to solve different problems at the closing table.
