A tax refund after buying a California home: Can I spend it?

A client's unexpected check explains California supplemental property taxes, escrow refunds and the questions to ask before spending the money.

Can I spend a property-tax or escrow refund after buying a home?

Set the money aside until you confirm who issued the check and why. An escrow surplus can be refunded before a purchase reassessment is fully reflected in the tax bills. A later supplemental bill or higher escrow payment may still follow. A legitimate county refund is different; receiving a check does not automatically mean the county will demand that same money back.

What is a California supplemental property tax bill?

A supplemental assessment accounts for a qualifying ownership change or completed new construction between annual assessments. For a taxable purchase, the county generally measures the change from the prior assessed value to market value at the ownership-change date. It does not simply use the home's value on the later date when paperwork is processed. Exclusions can change the result, so confirm unusual transfers with the assessor.

Is an escrow refund the same as a county tax refund?

No. An escrow or impound account holds money your mortgage servicer collects for taxes and insurance. Its analysis can show a surplus under the bills and projections used at that time. A refund from that account does not settle all future county taxes. Ask which tax amount the analysis used and whether it reflects your purchase reassessment.

A county refund can instead reflect a lower assessed value, an overpayment or a correction. Closing escrow can also send a separate adjustment. Ask for the reason in writing. Do not assume a legitimate refund must be returned, and do not send money back just because someone calls requesting repayment. In this illustration, the supplemental amount is $2,250. The ongoing annual base-tax difference is $3,000, or $250 a month. Those are different amounts for different periods. A future escrow shortage repayment may add another temporary charge; paying the supplemental bill does not by itself update the servicer's monthly estimate.

Why can there be two bills, and will my lender pay?

California's property-tax fiscal year runs July 1 through June 30. A January through May ownership change generally produces two supplemental bills covering different fiscal periods; June through December generally produces one. Multiple changes can produce more. Read each notice's dates and parcel number before assuming a duplicate. Supplemental bills go to the owner; do not assume the lender receives or automatically pays them.

A Notice of Supplemental Assessment explains the value calculation; it is not the tax bill. A supplemental bill is separate from the regular annual bill. An escape assessment addresses previously omitted or underassessed taxable value and is another category to ask the assessor about. Match the actual document type to its payment instructions and deadlines.

What should I do before spending the check?
  1. Keep the check, letter, closing statement and latest escrow analysis together. Verify the issuer and keep the funds available while you investigate.
  1. Ask the assessor whether the purchase reassessment is complete. Ask the tax collector which bills are issued, unpaid or pending and what their due dates are. Keep paying existing bills as instructed; a pending review or refund does not automatically cancel them.
  1. Ask the servicer to confirm the tax projection, whether it will pay a specific supplemental bill, and whether another escrow analysis is needed. Get the payment arrangement in writing and verify that payment posts before the delinquency date. Separately budget for the future annual tax level.
Can my payment rise even with a fixed-rate mortgage?

Yes. A fixed interest rate does not freeze property taxes or insurance. A higher ongoing escrow deposit and repayment of an earlier shortage can both affect the amount collected. Ask for a breakdown rather than assuming the interest rate changed. A client called about a large check

We recently heard from a client who received a large check after buying a home and did not know what to do with it. The concern was that the purchase reassessment had not yet caught up with the tax billing. Before calling it extra spending money, I would match the check with its explanation and the property's tax records.
