Certain mortgage cost tests depend on the charges counted and the size of the loan. On a smaller balance, fixed costs can represent a larger share of the transaction. A lender may need to revisit the structure even when the monthly payment appears workable.
The issue that surfaced near documents
A file reached the document stage and failed a Qualified Mortgage check. The team discussed point costs, title and escrow charges and alternative pricing. The correspondence did not establish a completed passing calculation or an approved remedy.
I would not name one fee as the cause without the actual test. A conversation about possible changes is not the same as a compliance determination.
Ask which test is involved
The CFPB’s Qualified Mortgage rules include limits on points and fees, with thresholds that vary by loan size and are adjusted over time. Not every closing charge is treated identically in that calculation.
Ask the lender to identify the test, the applicable threshold and the charges it counted. Qualified Mortgage, high-cost mortgage and higher-priced mortgage rules are different concepts; the shorthand “fee problem” does not explain which one needs attention.
Compare legitimate alternatives
If pricing changes are proposed, compare the complete result: rate, APR, upfront costs, credits, payment and expected time holding the loan. Reducing upfront points can change the rate and longer-term cost. A smaller initial charge is not automatically a better total deal.
Do not relabel a fee or omit an obligation to make a test appear to pass. Ask for an accurate, compliant comparison and confirmation of the final review.
My focus would be on understanding the constraint early enough to make an informed choice, rather than learning about an unexplained cost issue when the signing is already being arranged.
